Readoption of Rules Contained in 04 NCAC 03
Explanation for Proposed Rule:
As part of the requirements of N.C. Gen. Stat. §150B-21.3A (Periodic Review of Existing Rules), the N.C. Office of the Commissioner of Banks (NCCOB) proposes the readoption of the following rules:
Subchapter 03E - Licensees Under North Carolina Consumer Finance Act;
Subchapter 03F - Licensees Under Money Transmitters Act;
Subchapter 03H - Applications by Regional Bank Holding Companies;
Subchapter 03J - Refund Anticipation Loan;
Subchapter 03K - Reverse Mortgages;
Subchapter 03L - Check-Cashing Businesses; and
Subchapter 03M - Mortgage Lending
NCCOB and the State Banking Commission have met with industry stakeholders to review the above rules and have determined that these rules need to be amended or repealed to modernize and clarify language, reduce regulatory burden, and align with North Carolina statutes.
||Pursuant to N.C. Gen. Stat. 150B-21.2(c)(1), the text of a rule proposed for readoption with no change or without substantive change is not required to be published in the North Carolina Register (the “NC Register”). However, the rule citation shall be provided on the Notice of Text below. The Office of Administrative Hearings will also include the rule citation and name of the rule in the published notice.
The rules below include all rules in Subchapters 03E, 03F, 03H, 03J, 03K, 03L, and 03M with amendments, including those determined to be without substantive change. The highlighted rules contain technical changes to the version that was published in the NC Register as a result of feedback from Rules Review Commission staff and other stakeholders.

A public hearing was held for the rules in Section 04 NCAC 03 on Thursday, May 3, 2018, in the 2nd Floor Hearing Room at 316 W. Edenton Street, Raleigh, NC 27603.
Public comment regarding these rules ended June 1, 2018.
